Processing of your data within the scope of our company's core activity
If you are our customer or business partner or are interested in our services, the nature, scope and purpose of the processing of your data is determined by the contractual or pre-contractual relationship existing between us. In this sense, the data processed by us includes all data that is or has been provided by you for the purpose of using the contractual or pre-contractual services and that is required to process your enquiry or the contract concluded between us. Unless otherwise stated in the further information of this privacy policy, the processing of your data and its transmission to third parties is limited to the data that is necessary and appropriate for answering your enquiries and/or fulfilling the contract concluded between you and us, for protecting our rights and for fulfilling legal obligations. We will inform you which data is required for this purpose before or during the data collection. Insofar as we use third-party providers to render our services, the privacy notices of the respective third-party providers apply.
Data concerned:
-
Inventory data (e.g. names, addresses)
-
Payment data (e.g. bank account details, invoices)
-
Contact data (e.g. e-mail address, telephone number, postal address)
-
Contract data (e.g. subject matter of the contract, contract duration)
Data subjects: Prospects, business and contract partners
Purpose of processing: Provision of contractual services, communication and answering of contact enquiries, office and organisational procedures
Legal basis: Performance of a contract and pre-contractual enquiries, Art. 6 (1) (b) GDPR, legal obligation, Art. 6 (1) (c) GDPR, legitimate interest, Art. 6 (1) (f) GDPR
Your rights under the GDPR
Under the GDPR, you have the rights listed below, which you can assert at any time vis-à-vis the controller named in item 1 of this privacy policy:
Right of access: You have the right to request information from us as to whether and which of your data we process.
Right to rectification: You have the right to request the rectification of inaccurate data or the completion of incomplete data.
Right to erasure: You have the right to request the erasure of your data.
Right to restriction of processing: In certain cases, you have the right to request that we process your data only to a limited extent.
Right to data portability: You have the right to request that we transmit your data to you or to another controller in a structured, commonly used and machine-readable format.

You have the right to revoke your consent to data processing at any time.
Right to object
You have the right to object at any time to the processing of your data that we base on our legitimate interest under Art. 6 (1) (f) GDPR. If you make use of your right to object, we ask you to state your reasons. We will then no longer process your personal data, unless we can demonstrate to you that compelling legitimate grounds for the processing override your interests and rights.
Irrespective of the above, you have the right at any time to object to the processing of your personal data for purposes of advertising and data analysis.
Please address your objection to the contact address of the controller given above.
When do we delete your data?
We delete your data when we no longer need it or when you instruct us to do so. This means that – unless otherwise stated in the individual privacy notices of this privacy policy – we delete your data,
-
when the purpose of the data processing has ceased to apply and the respective legal basis named in the individual privacy notices no longer exists, e.g.
-
after termination of the contractual or membership relationship existing between us (Art. 6 (1) (a) GDPR), or
-
after our legitimate interest in the further processing or storage of your data has ceased to apply (Art. 6 (1) (f) GDPR),
-
-
when you make use of your right of revocation and no other statutory legal basis for processing within the meaning of Art. 6 (1) (b)–(f) GDPR applies,
-
when you make use of your right to object and there are no compelling legitimate grounds opposing the erasure.
However, if we must retain (certain parts of) your data for other purposes, because this is required, for example, by statutory retention periods (as a rule, 6 years for business correspondence or 10 years for accounting records) or by the assertion, exercise or defence of legal claims arising from contractual relationships (up to four years), or because the data is needed to protect the rights of another natural or legal person, we will delete (the part of) your data only after expiry of these periods. Until these periods expire, we will, however, limit the processing of this data to these purposes (fulfilment of the retention obligations).
Cookies
Our website uses cookies. Cookies are small text files consisting of a series of numbers and letters that are placed and stored on the terminal device you use. Cookies primarily serve to exchange information between the terminal device you use and our website. This includes, among other things, the language settings on a website, the login status or the point at which a video was watched.
When you visit our websites, two types of cookies are used:
Temporary cookies (session cookies): These store a so-called session ID, which allows different requests from your browser to be assigned to the shared session. The session cookies are deleted when you log out or close your browser.
Permanent cookies: Permanent cookies remain stored even after the browser is closed. As a result, our website recognises your computer again when you return to our website. These cookies store, for example, information on language settings or login information. In addition, your surfing behaviour can also be documented and stored by means of these cookies. This data can be used for statistics, marketing and personalisation purposes.
In addition to the above classification, cookies can also be distinguished with regard to their purpose of use:
Necessary cookies: These are cookies that are absolutely necessary for the operation of our website in order to store logins or shopping carts for the duration of your session, or cookies that are set for security reasons.
Statistics, marketing and personalisation cookies: These are cookies that are used for analysis purposes or audience measurement. Such "tracking" cookies may in particular store information on entered search terms or the frequency of page views. In addition, the surfing behaviour of an individual user (e.g. viewing certain content, using functions, etc.) can also be stored in a user profile. Such profiles are used to display content to users that corresponds to their potential interests. Insofar as we use services via which cookies are stored on your terminal device for statistics, marketing and personalisation purposes, we inform you of this separately in the following sections of our privacy policy or when obtaining your consent.
Data concerned:
-
Usage data (e.g. access times, pages clicked on)
-
Communication data (e.g. information about the device used, IP address)
Data subjects: Users of our online offerings
Purpose of processing: Delivery of our websites, ensuring the operation of our websites, improvement of our online offering, communication and marketing
Legal basis: Legitimate interest, Art. 6 (1) (f) GDPR
Unless we obtain your consent to the setting of cookies, we base the processing of your data on our legitimate interest in improving the quality and user-friendliness of our website, in particular its content and functions. You can object to the use of the cookies set by us within the scope of our legitimate interest via the security settings of your browser. There you have the option of specifying whether, for example, you do not accept any cookies from the outset or only upon request, or of specifying that cookies are deleted each time your browser is closed. If cookies are deactivated for our website, it may no longer be possible to use all functions of the website to their full extent.
Web hosting
We use a provider to host our websites, on whose servers our websites are stored and made available for retrieval on the internet (hosting). In this process, the provider may process all data transmitted via the browser you use that is generated when using our websites. This includes in particular your IP address, which the provider requires in order to deliver our online offering to the browser you use, as well as all entries you make on our website. In addition, the provider we use may collect the following data:

-

Content Delivery Network
We use a content delivery network (CDN) to deliver our websites. A CDN is a network of regionally distributed servers connected via the internet. The CDN provides scalable storage and delivery capacities. As a result, the loading times of our websites are optimised and optimum data throughput is guaranteed even at times of peak load. User requests on our websites are routed via servers of the CDN. Statistics are compiled from these data streams. This serves on the one hand to identify potential threats to our websites from malware at an early stage and on the other hand to continuously improve our offering and make our websites more user-friendly for you as a user.
We would like to point out that, depending on the country in which the service provider named below is based, the data collected via the service may be transferred and processed outside the territory of the European Union. In this case, there is a risk that the level of data protection prescribed by the GDPR may not be maintained and that the enforcement of your rights may not be possible or may only be possible with difficulty.

Even after revocation, we may store your e-mail address for up to three years on the basis of our legitimate interests before deleting it, in order to be able to prove that you concluded the subscription. After your revocation, we store your e-mail address exclusively for this purpose. We will delete your e-mail address early if you confirm to us that you previously gave your consent to the subscription.

If this is necessary for the fulfilment of the contract concluded between us, for the protection of your vital interests or due to statutory provisions, we will transmit your data, taking your rights into account, to third parties, e.g. to the logistics company commissioned with the delivery, to payment service providers for the purpose of payment processing, and to our tax advisor. Insofar as we use third-party providers to render our services, the privacy notices of the respective third-party providers apply.

Chat services
We communicate via online chats and/or chatbots (hereinafter referred to as chat services). An online chat is understood to be the exchange of text messages over the internet in real time. Chatbots are computer programs that are usually used on websites in order to answer user queries automatically or to display notifications to users.
If you use our chat services, we collect your access data. This includes in particular the IP address of the requesting device, the date and time of the request, and your identification number. Furthermore, we store the content of the communication conducted via the chat services. Finally, we log your registration and your declaration of consent. We use this data in order to be able to communicate with you via our chat services, to address you personally, to answer your queries, and to transmit any requested content.
The service provider(s) named below has/have the option of accessing the metadata of the communication. This includes the time and (depending on the setting) the location of the communication, the device you use, and the information on who communicated with whom. The provider's access to the metadata generally takes place in order to optimise the service or for security reasons. In addition, however, the provider's access may also take place in order to use the data for marketing purposes. You can find more information on this in the privacy policy of the service provider, which we have linked below.
We would like to point out that, depending on the country in which the provider named below is based, the data collected via its platform may be transferred and processed outside the territory of the European Union. In this case, there is a risk that the level of data protection prescribed by the GDPR may not be maintained and that the enforcement of your rights may not be possible or may only be possible with difficulty.
Data concerned:

Inventory and contact data (e.g. name, telephone number, e-mail address)
-
Content data (e.g. text entries)
-

-
Communication data (e.g. information about the device used, IP address)
Purpose of processing: Communication and marketing
Legal basis: If we have asked you for your consent before the use of the respective chat service, this consent constitutes the legal basis, Art. 6 (1) (a) GDPR. In this respect, we make clear that we do not initially transmit your contact data to the service provider without your consent. If we communicate with you via one of the services named below as part of contract initiation or within the scope of an existing contractual relationship, the legal basis is the fulfilment or preparation of the contract, Art. 6 (1) (b) GDPR. Otherwise, we rely on our legitimate interests in fast and efficient communication and in fulfilling the needs of our communication partners in communicating via the services named below, Art. 6 (1) (f) GDPR.

How our live chat is technically integrated
Our live chat is technically integrated in such a way that it is only loaded after your explicit consent: before you click the activation button, no data is transmitted to the chat provider Brevo and no chat cookies are set. Your consent is stored locally in your browser only (so-called localStorage); this is not a cookie and not a tracking mechanism. This local storage serves exclusively to document your consent so that the chat does not ask again on subsequent visits. The consent automatically expires after 180 days — after that, the chat is only loaded again once you have given renewed consent.
Withdrawal of consent: You may withdraw your consent at any time with effect for the future by deleting the website data for schwerkraft-verlag.de in your browser settings (this removes the entry "brevo_chat_accepted") or by sending us a message to the contact address stated above. Upon request, we will additionally delete your chat history stored at Brevo as well as any contact data that may have been transmitted.
Logged-in customers: If you are logged into your customer account at the time of using the chat, your name, e-mail address and customer number will be transmitted to Brevo after you have given your chat consent, so that our service team can identify you directly. This transmission takes place exclusively after the consent described above.
Security measures
Furthermore, we take technical and organisational security measures in accordance with the state of the art in order to comply with the provisions of the data protection laws and to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or unauthorised access by third parties.
